IMPORTANT: VRH267 is a supplemental outdoor information, navigation and safety-awareness tool. It is not an emergency-response service, a rescue organisation, a certified personal protective device or a substitute for independent judgment, appropriate equipment and contacting emergency services. See Sections 3–9 and the Safety Notice at the end of these Terms.

1. Agreement and scope

1.1. These Terms of Service ("Terms") govern your access to and use of the VRH267 mobile applications, websites and related features and content (together, the "Service"). The Service is provided by BRIGHTWING7 LLC ("VRH267", "we", "us" or "our").

1.2. By selecting an acceptance control, creating an account or using the Service after being given a reasonable opportunity to review these Terms, you agree to them. If you do not agree, do not use the Service. Where applicable law requires a different method of acceptance, that law controls.

1.3. Additional terms may apply to particular paid plans, third-party bookings, promotions or features. We will make those terms available before they apply. If there is a conflict, feature-specific terms control only for the relevant feature and only to the extent permitted by law.

1.4. Our Privacy Policy explains how we process personal data. It is a separate notice, not a waiver of privacy rights. Any permissions or consents required for location, notifications or sensitive personal data must be obtained separately where required by law.

1.5. Nothing in these Terms limits rights or remedies that cannot lawfully be excluded, including mandatory consumer rights in your country of residence.

2. What the Service does — and does not do

2.1. Depending on location, device, permissions, connectivity, plan and release version, the Service may offer route discovery, maps, 2D and 3D terrain visualisation, elevation profiles, hiking information, offline downloads, weather and trail information, personal journals, virtual stamps, community features, mountain huts, guides, activity planning and supplemental safety features.

2.2. Features described as planned, experimental, beta, preview or coming soon are not promised features of the current Service. A feature is available only when it is actually enabled and described as available in the relevant app version. Functionality can vary by country, device and operating system.

2.3. The Service is not a mountain guide, an emergency dispatch centre, a rescue or medical service, an official weather or avalanche authority, a professional risk assessment, a certified emergency communication device or a replacement for printed maps, navigation skills or safety equipment.

2.4. We do not supervise your journey, verify that you are safe, or promise that anyone is monitoring your status in real time. The Service cannot eliminate the inherent risks of activities in nature.

3. Outdoor activities involve serious risks

3.1. Hiking, mountaineering, climbing, trail running, skiing, ski touring and other outdoor activities may involve falls, steep or unstable terrain, rockfall, avalanches, lightning, severe weather, altitude, wildlife, road hazards, remote locations, injury, permanent disability or death.

3.2. You are responsible for deciding whether an activity is suitable for you, assessing your abilities and health, checking current official information and access restrictions, choosing appropriate equipment, planning alternatives, informing a trusted person of your plans where appropriate and turning back when conditions require it.

3.3. No displayed route, difficulty rating, estimated completion time, safety indicator, absence of an alert or suggested itinerary is a representation that a route is safe, open, legally accessible, suitable for you or free from hazards.

3.4. When an app display conflicts with signs, closures, instructions from competent authorities, professional guidance or conditions you can observe, use independent judgment and give priority to applicable legal restrictions and actual conditions.

4. Essential emergency and SOS limitations

4.1. VRH267 is not an emergency communications or rescue service. Its manual SOS and other assistance features are supplemental tools for preparing, displaying or attempting to share information with designated contacts or other recipients when the relevant feature is available.

4.2. Pressing an SOS button in VRH267 does not itself call 112, 911 or any other emergency number, and it does not guarantee that a rescue service, emergency contact or other person has been notified. Unless a clearly identified, separately activated integration expressly states otherwise, VRH267 does not operate a staffed emergency response centre and does not dispatch or coordinate rescues.

4.3. An SOS message or alert may fail to be generated, transmitted, delivered, opened, understood or acted upon, or it may be delayed. Delivery can depend on device power, GPS availability, operating-system permissions, background execution, internet or mobile coverage, third-party messaging providers, recipient availability and other factors.

4.4. An on-screen confirmation that an alert was prepared, triggered, queued or sent is not confirmation that emergency services were contacted or that a recipient received, read or accepted responsibility for the alert. Treat only a reliable, explicit delivery acknowledgement as evidence of delivery, and never as proof that help is on the way.

4.5. If you need urgent assistance, contact local emergency services directly by the available means. In Slovenia and elsewhere in much of Europe, the emergency number is 112; emergency numbers differ by location. Where ordinary communications are unavailable, use appropriate alternative emergency communication equipment and established rescue procedures if available.

4.6. We do not undertake to initiate a search, physically locate you, organise transport, alert the authorities or rescue you. Nothing in these Terms excludes any duty imposed on us by mandatory law.

5. Automated detection and supplemental safety features

5.1. If enabled, fall or incident detection may use a phone's accelerometer, gyroscope, location data and software-derived patterns. It can miss a genuine fall or incident, trigger after a delay, or generate a false positive. Performance changes with how the device is carried, impact characteristics, movement, battery settings and hardware.

5.2. Inactivity and check-in features may misinterpret rest stops, poor positioning, lost tracking or inactivity. A missed check-in or failure to return may not be detected or escalated.

5.3. Off-route alerts compare estimated positions with digital routes; GPS drift, route inaccuracies, complex terrain or unavailable location updates may generate incorrect alerts or no alert at all. Staying within an on-screen corridor does not mean the ground is safe.

5.4. Battery warnings and last-known-position features depend on data received by the Service. A battery may fail without warning, and a last-known position may be inaccurate or substantially out of date.

5.5. Weather, thunderstorm, lightning, wind, snow and avalanche information may be derived from third-party forecasts, bulletins, models, sensors or user reports. These data can be incomplete, delayed or unsuitable for rapidly changing local conditions. A missing or low-risk indicator is not an all-clear.

5.6. Avalanche-related displays and warnings are not avalanche transceivers, avalanche search systems, official bulletins or a substitute for avalanche training, a shovel, a probe, a transceiver and responsible terrain decisions.

5.7. If family, group, live-location or expedition communication features become available, they may not work without network connectivity or may require compatible hardware, active participation or specific permissions. They are not a guarantee of continuous group supervision, receipt of a distress signal or availability of a guide.

5.8. We may provide feature-specific instructions, limitations, safety testing modes or operational notices. You must follow those instructions. You must not treat demonstrations, beta features or test alerts as verified emergency systems.

5.9. The absence of an alert does not mean the absence of danger. The activation of an alert does not mean that assistance has been dispatched.

6. Maps, routes, GPS and 3D terrain

6.1. Maps, trails, parking locations, huts, coordinates, elevation, distances, durations, difficulty classifications, 3D views and route recommendations are informational estimates. They may be incomplete, out of date or wrong.

6.2. Actual routes can be closed, damaged, obstructed, dangerous, unmarked, privately restricted or impassable. Map graphics may omit cliffs, exposure, seasonal snow, damaged bridges, temporary restrictions or other hazards. Some routes or segments may originate from public datasets, community submissions or automated processing.

6.3. GPS and other positioning methods can be degraded by mountains, forests, tunnels, weather, buildings, hardware, map projections and signal conditions. A displayed marker may not show your precise location.

6.4. 3D terrain, satellite imagery and route animations are visualisations, not guaranteed representations of the terrain at the time of your visit. Do not make exposure, avalanche, cliff or route-selection decisions solely from a 3D display.

6.5. You must verify current route conditions with authoritative sources and competent local advice where appropriate. Estimated walking times and difficulty labels do not account for every individual, season, weather condition or emergency.

7. Offline operation; connectivity and devices

7.1. Downloaded maps or saved routes may continue to display without internet access where supported. Offline map availability must never be interpreted as offline SOS delivery, emergency dispatch, live tracking or live weather access.

7.2. Offline data may be incomplete, corrupted, deleted or made unavailable by insufficient storage, updates, a damaged device or changes to local files. Downloads may not include all levels of detail, geographic areas or supplementary information.

7.3. Some features require adequate power, operating-system support, location permissions, background activity, notifications, an active data connection, third-party infrastructure or compatible external devices. Operating systems may suspend background processing without advance notice.

7.4. Before an activity, check your battery, downloaded area, route data, settings, permissions, signal options and backup navigation and emergency arrangements. Testing one feature does not establish that it will work in every environment.

7.5. We do not promise uninterrupted, error-free or universal availability. We nevertheless remain responsible for any service conformity, security or other obligations imposed by law.

8. Emergency contacts, medical data and location sharing

8.1. Where offered, you may choose to provide emergency contacts, itinerary details, location data or optional information such as allergies, medications and other health-related details. Only provide information you are entitled to share, keep it accurate and notify your designated contacts of the purpose for which their details may be used.

8.2. Entering an emergency contact does not establish that they are available, have accepted a legal duty to respond, or will receive an alert. A notification recipient is not a replacement for emergency services.

8.3. Medical and ICE information is user-provided and not independently verified. It does not constitute an authenticated medical record or professional medical advice.

8.4. You control the sharing options actually provided by the Service. Before publishing an activity or sharing live location, consider risks arising from revealing your home, routines, travel plans or whereabouts. Do not use the Service to track a person without a lawful basis and any required consent.

8.5. The collection and processing of location, health-related and other personal information are described in our separate Privacy Policy. Where required, we will request specific permissions or explicit consent and provide means to exercise applicable data-protection rights.

9. No insurance or guaranteed rescue

9.1. The Service does not include mountain-rescue insurance, travel insurance, medical cover or reimbursement of emergency, evacuation, search, transport or third-party charges unless a separate product expressly states otherwise.

9.2. Public authorities and independent rescuers determine whether, when and how they respond, subject to local law, weather, safety and available resources. We do not control them or guarantee any response time or outcome.

9.3. You are responsible for considering whether insurance or other protective arrangements are appropriate for your activities. Any rescue costs are governed by applicable law and the terms of the relevant provider; VRH267 does not automatically assume them.

10. Eligibility and accounts

10.1. You must be legally capable of accepting these Terms, or use the Service with the involvement and consent of a parent or legal guardian where permitted by law. Any minimum age, parental-consent requirements and app-store age classifications displayed for the Service also apply.

10.2. You must provide accurate account information, protect your credentials and tell us promptly if you reasonably suspect unauthorised access. You are responsible for activity through your account to the extent attributable to you under applicable law.

10.3. You must not impersonate others, create accounts to evade restrictions or use another person's account without authorisation.

10.4. Parents and guardians should supervise minors, particularly when enabling location sharing, public posting or emergency-contact features. A child must not be encouraged to rely exclusively on the Service for safety.

11. Community, journals, photos and route submissions

11.1. You retain ownership of photographs, journal entries, routes and other original content you submit ("User Content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, reproduce, adapt for technical display, transmit and display that User Content only as reasonably necessary to operate the Service, deliver the sharing settings you select, protect the Service and comply with law. Public promotion or unrelated commercial reuse requires a separate basis or permission where required.

11.2. You represent that you have the necessary rights to submit User Content and that it does not unlawfully infringe another person's copyright, privacy, image rights or other rights. You must not upload private information about others without a lawful basis.

11.3. You must not publish knowingly false safety reports, dangerous instructions presented as reliable facts, unlawful material, threats, harassment, unlawful tracking, malware, spam or content that violates applicable law. Do not recommend trespassing or disregard of closures.

11.4. User Content may be incomplete, inaccurate or misleading; it is not independently verified unless explicitly identified as verified. We do not endorse a user-submitted trail merely because it appears in the Service.

11.5. We may remove or restrict unlawful or Terms-violating content and may apply proportionate account restrictions. Where the EU Digital Services Act or other law applies, we will provide required reporting channels, notices, statements of reasons and available appeals or redress. We will disclose any material use of automated moderation as required by law.

11.6. When account deletion is requested, we will deal with User Content and personal data in accordance with our Privacy Policy and applicable law. Content already lawfully shared with or retained by others may not always be fully retrievable or removable from their systems.

12. Guides, huts, agencies, events and external bookings

12.1. Listings, links and descriptions of guides, huts, accommodation providers, agencies, events, transport or other businesses are informational unless a booking flow explicitly identifies a different contractual role for VRH267.

12.2. Unless the booking information expressly states that we are the provider or contracting party, any agreement for guiding, accommodation, trips, transport or other third-party services is between you and the relevant independent provider. That provider is responsible for its services, permits, licences, qualifications, price disclosures and contractual obligations.

12.3. We do not guarantee a provider's availability, qualifications, safety, performance or accuracy of a listing. The presence of a listing does not amount to a certification or endorsement. You should verify credentials and relevant information directly.

12.4. If we later enable payments or bookings as an agent or marketplace, the applicable checkout disclosures, provider identification, cancellation policies and mandatory marketplace obligations will govern that transaction.

13. Subscriptions, purchases and renewal

13.1. We may provide free features and paid plans, including products identified as PRO, Tourist or other names. Only the plan, price, term and benefits displayed at the time of purchase form part of that purchase. Descriptions of future features are not included unless expressly stated.

13.2. Before purchase we will disclose the total price, currency, tax treatment where applicable, billing period, whether renewal is automatic, the renewal price, any introductory or trial period and how to cancel. We will obtain any confirmation required by the relevant app store and applicable law.

13.3. A subscription renews automatically only if the checkout expressly says it does. When automatic renewal applies, charges recur for the disclosed billing period until cancelled. A fixed seven-day pass does not renew unless the checkout clearly states otherwise.

13.4. Purchases through Apple App Store or Google Play are billed and managed in accordance with the relevant store's purchase processes and applicable legal rules. To cancel a store-billed subscription, use that store's subscription-management function. Merely deleting the VRH267 app does not ordinarily cancel a store subscription.

13.5. Cancellation normally prevents the next renewal; access for an already-paid period ordinarily continues until that period ends, unless the checkout terms or mandatory law require another result. Statutory withdrawal, refund and conformity rights are unaffected.

13.6. Any price increase for an existing recurring subscription will be communicated and implemented with the notice or consent required by applicable law and the relevant billing platform. We will not apply an unannounced increase retroactively.

13.7. If a payment fails, access to paid functions may be suspended after any applicable grace period. Core features advertised as free will not be made conditional on a paid subscription without an appropriate update to the Service description and compliance with applicable consumer law.

14. EU/EEA/UK consumer rights and withdrawal

14.1. If you are a consumer, you retain all mandatory rights under the laws applicable to your contract, including rights concerning the supply and conformity of digital content and digital services. Nothing in these Terms waives statutory remedies for non-conforming or undelivered services.

14.2. Where a statutory cooling-off or withdrawal right applies to an online purchase, we and/or the merchant of record will provide the required pre-contractual information, instructions and any model withdrawal form. For many EU distance contracts the period is 14 days, subject to lawful exceptions and the nature of the contract.

14.3. The start of digital supply does not, by itself, eliminate every withdrawal right. Any legally available loss of a withdrawal right for non-tangible digital content requires the applicable express consent, acknowledgement and confirmation process. Different rules can apply to ongoing digital services.

14.4. If the store or seller of record handles withdrawal or reimbursement requests, the purchase confirmation will identify the appropriate route. That arrangement does not remove rights you have against us under mandatory law where we remain legally responsible.

15. Intellectual property and permitted use

15.1. Subject to third-party and open-source rights, we or our licensors own the software, distinctive branding, original design and protected materials of the Service. We grant you a limited, personal, revocable, non-exclusive, non-transferable licence to use the Service as permitted by these Terms and applicable law.

15.2. Except where lawful exceptions or third-party licences permit it, you must not copy, sell, repackage, scrape at an abusive scale, circumvent technical restrictions, interfere with security or commercially exploit protected Service components without authorisation.

15.3. Map and third-party data may have additional attribution, access and reuse conditions. Nothing in these Terms transfers ownership of third-party map data or overrides mandatory open-source licence rights.

15.4. If you send suggestions or feedback, we may use them to improve the Service without a payment obligation, but this does not grant us ownership of your pre-existing intellectual property.

16. Prohibited and unsafe uses

16.1. You must not use the Service to stalk or unlawfully monitor anyone; interfere with emergency contacts; deliberately send false distress messages; create deceptive safety information; violate access restrictions; transmit malicious code; or interfere with availability for other users.

16.2. You must not advertise a route as risk-free or represent that VRH267 certifies a route, instructor, outdoor activity or rescue plan unless we expressly provide such certification in writing.

16.3. You are responsible, to the extent provided by law, for harm resulting from your intentional or unlawful misuse. Any claim for reimbursement of reasonably incurred losses, including losses caused by knowingly false alerts, is subject to proof, causation and applicable legal restrictions; this is not a blanket penalty.

17. Third-party services and external links

17.1. The Service may depend on maps, weather feeds, notification infrastructure, payment processors, analytics, device operating systems and external websites. Some services have their own terms and privacy practices.

17.2. We do not control every third party's independent systems, publications or performance. We may be unable to prevent an interruption or correct an external error immediately. This does not excuse any due-care, security or consumer obligations that the law places on us.

17.3. An external link is not a guarantee or endorsement of the linked offering.

18. Availability, changes and termination

18.1. We may perform maintenance, fix defects, provide security updates, modify features and restrict access where reasonably needed for security, legal compliance or misuse prevention. We will comply with laws governing changes to ongoing digital services and users' rights to information, termination or remedies.

18.2. We may suspend or terminate an account for material misuse, unlawful conduct, security threats or repeated serious violations, taking account of proportionality, notice and redress duties where required.

18.3. You may stop using the Service and request account deletion using the available account controls or contact channel. Closing an account does not automatically cancel a subscription billed through an app store; cancel billing separately where necessary.

18.4. Provisions that by their nature should survive termination, including accrued payment obligations, lawful content licences, intellectual-property rights, dispute rules and limitations of liability, survive only to the extent permitted by law.

19. Disclaimer of warranties

19.1. To the maximum extent permitted by applicable law, and without restricting mandatory guarantees or service-conformity rights, the Service and informational content are offered on an “as available” basis. We do not promise that every route, measurement, forecast, signal, alert, map tile, recommendation or third-party listing will be accurate, complete, uninterrupted, current or suitable for a particular expedition.

19.2. We make no guarantee that the Service will prevent injury, death, loss of property, being lost, exposure to dangerous weather or the failure of rescue communications.

19.3. Any legally required assurances concerning digital-service conformity, reasonably expected functionality, security, updates and our express representations remain in force notwithstanding these disclaimers.

20. Limitation and allocation of liability

20.1. Inherent outdoor risks. To the fullest extent permitted by applicable law, VRH267 is not responsible for the inherent hazards of outdoor activities or for the consequences of independent decisions, third-party actions or environmental conditions that are not legally attributable to our breach of duty.

20.2. Safety-feature limitations. To the fullest extent permitted by applicable law, we are not liable merely because a fall was not detected, an alert was delayed, an SOS message was not delivered, a forecast was inaccurate, a device lost its connection or rescue services did not respond, where this was not caused by a breach of our legally applicable obligations.

20.3. Indirect losses. To the extent allowed by applicable law, we exclude liability for unforeseeable or indirect commercial losses, lost profits, loss of business opportunity and comparable purely economic consequential losses that are not recoverable under governing law.

20.4. Business-user monetary limit. If you use the Service primarily for business purposes, and only to the extent lawful, our total aggregate contractual liability arising from the Service is limited to the greater of (a) amounts paid by you to us for the Service during the 12 months preceding the event giving rise to the claim or (b) USD 100. This cap does not apply to Excluded Claims under Section 20.5 or any liability that cannot lawfully be capped.

20.5. Excluded Claims and mandatory rights. Nothing in these Terms excludes or restricts liability for fraud, wilful misconduct, gross negligence, death or personal injury where exclusion is prohibited, defective-product liability where mandatory law applies, personal-data violations where limitation is prohibited, or any other claim, guarantee, consumer remedy or duty that cannot lawfully be excluded or limited.

20.6. No assumption of rescue duty. Providing supplemental information or an automated notification feature does not itself mean we undertake to supervise you, continuously monitor alerts, dispatch rescuers, provide medical treatment or ensure a successful emergency response. This clause does not override duties that arise under mandatory law or from specific commitments we expressly make.

20.7. Country-specific operation. Some jurisdictions do not permit certain exclusions, caps or disclaimers. In those places the relevant clause applies only as far as legally permitted, and mandatory national rights prevail.

21. Indemnification for unlawful misuse

21.1. If you are using the Service for business purposes, you agree, to the extent permitted by law, to reimburse us for reasonable, properly substantiated third-party claims and costs directly caused by your intentional or unlawful misuse, infringement of third-party rights, or material breach of these Terms.

21.2. This provision does not require consumers to indemnify us for our own wrongdoing, remove statutory consumer protections, or reimburse costs that the law does not permit us to recover.

22. Privacy, safety records and lawful disclosures

22.1. Personal-data practices are governed by our Privacy Policy and applicable law, including the GDPR where applicable. We describe the purposes, retention periods, recipients, international transfers and rights associated with location, activity, emergency contact and optional health information in that policy.

22.2. Where lawfully permitted and reasonably necessary in an emergency, we may disclose relevant information to emergency contacts, responders or competent authorities in accordance with the Privacy Policy and applicable legal bases. We do not promise that such disclosure will be technically possible or monitored in real time.

22.3. Please report security vulnerabilities through our published contact channel. Do not attempt to exploit vulnerabilities or access another person's information.

23. Complaints, applicable law and disputes

23.1. You can contact us at support@vrh267.com with complaints, support requests or questions about the Service. We will handle complaints according to any response and consumer-redress obligations that apply.

23.2. Subject to all mandatory consumer-protection rules, these Terms are governed by the laws of the State of New Mexico, United States, without giving effect to conflict-of-law principles that would displace that choice. If you are a consumer resident in the EEA, UK or another jurisdiction with mandatory consumer protections, this clause does not deprive you of those protections.

23.3. Any court-jurisdiction arrangement applies only where lawful. If applicable law entitles you to bring proceedings in your home jurisdiction or protects you from a mandatory foreign forum, those rights remain unaffected.

23.4. We do not impose mandatory private arbitration or a class-action waiver on consumers through these Terms. Any later change to dispute procedures must be separately reviewed for legality in each relevant market.

24. Changes to these Terms

24.1. We may revise these Terms for legal, security, operational or product reasons. When changes materially affect users, we will give the notice and, where required, obtain the consent or provide termination rights prescribed by law.

24.2. Updated Terms will identify their effective date. Changes do not retroactively remove accrued statutory rights or change an existing paid agreement contrary to applicable law.

25. General

25.1. If a provision is unenforceable, the remaining provisions continue only where lawful and where the contract can fairly operate without the invalid term. An invalid provision is not automatically replaced with the broadest possible company-favouring restriction.

25.2. Our failure to enforce a provision on one occasion does not waive our right to enforce it later to the extent permitted by law.

25.3. These Terms are written in English. Where mandatory law requires information in another language or requires a local-language version to control, we will comply with those requirements.

25.4. We may not assign the consumer's contract in a way that unlawfully reduces the consumer's protections. The Service may be transferred as part of a legitimate business reorganisation subject to applicable legal duties.

25.5. Official notices to us may be sent to BRIGHTWING7 LLC, 2105 Vista Oeste NW, Suite E #3027, Albuquerque, NM 87120, United States, or to support@vrh267.com, subject to any formal-service requirements imposed by applicable law. This is a business correspondence address and is not represented here as the company’s statutory registered office.

VRH267 — Safety Notice

VRH267 is a supplemental navigation and safety-awareness tool, NOT an emergency service.

Recommended acknowledgement text: "I understand that VRH267 is a supplemental tool, that its safety alerts and SOS communications may fail, and that it does not replace calling emergency services or making my own safety decisions."
